We are not a property sales or lettings agency. We are an intermediary and the providers of the site. It is our members (which include buyers, sellers, and franchises which include individuals, agents") that display property details for you to view, buy, sell, Lease or Develop

     1.The terms set out all the rules, regulations and obligations that apply to your use of the site.

      2.By visiting our site, you agree and confirm that you accept these terms and that you agree to comply with them. If you do not agree to these terms, you must not use our site.

      3.You must be at least 18 years of age to use our site. By using our site and accepting these terms, you confirm that you are at least 18 years of age.

      4.These terms may also make reference to other terms that apply when using our site, such as our privacy policy and cookie policy.

     1.At any time from time to time, we may change, the content of this site or suspend or discontinue any aspect of this site, which may include your access to it.

5.Obligations and acceptable use

     1.You accept and agree that you are solely responsible for ensuring that your computer system meets all relevant technical specification necessary to use this site and that your computer system is compatible with this site.

     2.You must at all times make sure that you do not misuse our system or this site. In particular, you must not hack into, circumvent security or otherwise disrupt the operation of our system and this site, or attempt to carry out any of the foregoing.      3.As a User you agree not to submit any property descriptions, photographs, financial, contact or other information contained in each property's data of Cloud Farms unless the user undertaking such a Listing/Advertisement has acquired and received all necessary rights and authorizations from the owner or owners of such property or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the said Property(s) on the User's own website or on Cloud Farms' without its permission.

     4.If as a User, you are covered under RERA, or any other regulatory authority, government department, you shall obtain all requisite approvals, licenses and permits issued by the competent authorities with respect to the Project/Land/Lease Land//Agriculture land in the listing, by following the due process of law. Further, the User shall, at all times, remain in compliance with all applicable Laws in relation to the Project/Land/Lease Land/Agriculture land in the listing.

     5.As a user you shall disclose all material information as required by law or regulatory authority and all such property(s) submitted including the present status and nature of such property and shall also disclose whether the property is free from all encumbrances or not.

     6.The User shall disclose all material factual information as regarding the property being advertised, its correct dimensions, as also in respect of their registrations including the present status and nature of such property and shall also disclose whether the property is free from all encumbrances or not.

     7.The User in addition shall furnish a brief background of such property in respect of title, ownership and possession, Exclusivefarmland may also require the User to support the claims with respect to the status of the property with such documents as may be specified by it from time to time. The User may also be required to substantiate claims as to the nature and status of the property by swearing an affidavit stating the authenticity of the information/data so provided/displayed

    8.The User agrees to submit any payment amount to another User at any stage at its sole discretion and after conducting due-diligence.

    9.You must not at any time use or attempt to use any automated program (including, without limitation, any spider or other web crawler) to access our system or this site. You must not use any scraping technology on the site. Any such use or attempted use of an automated program shall be a misuse of our system and this site. Obtaining access to any part of our system or this site by means of any such automated programs is strictly unauthorised.

  10.You must not any time upload or use inappropriate or offensive language or content or solicit any commercial services in any communication, form or email you send or submit, from or to the site.

   11.Whenever you make use of features that allow you to upload content to our site, or to make contact with other users via our site, you must comply with the content standards set out in these terms. Please see clause 6 below. You warrant that any such contribution does comply with the standards mentioned in clause 6 and, if you are a business, you will indemnify us against any breach of this warranty. This indemnification may be for any but not limited to any direct, indirect loss or any claim of equitable relief.

6.Service and content

    1.When you fill out and submit an enquiry form on our site, your personal data will be processed in accordance with our privacy policy.

     2.All content that you upload to our site will be considered non-confidential and non-proprietary and we have the right to use any such content for any purpose, subject to the terms of our privacy policy. We also have the right to disclose your identity to any third party who claims or alleges that content posted or uploaded by you to our site breaches that third parties' legal rights.

    3.The views expressed by Users on our site do not represent our views or values.

    4.With UGC, users are submitting content to a platform. Those platforms need to promise to keep information safe, according to local and international regulations on privacy.

    5.This agreement lays out the terms for the use of a website or an app. If users disregard said rules, the agreement grants developers the right to discontinue the corresponding accounts.

    6.All content that you upload to our site must:

              1.Be accurate and accordance with law (where you state facts);

              2.Be genuinely held (where you state opinions); and

              3.Be accurate and you take full responsibility of the due-diligence of the documents uploaded or you claim to have with you;

              4.Be genuine, not misrepresenting, or in nature of fraud, or illegal;

              5.Comply with the applicable law of the country from which they were posted.

  • Your content must not:
              1.Contain any material which is defamatory of any person;

              2.Contain any information that is not genuine, fraudulent, misrepresenting, not obtained after coercion,

              3.Contain any information that you do not have the right or the authority to represent.
              
             4.Contain any material which is obscene, offensive, hateful, discriminatory, unethical, immoral or inflammatory; or

             5.Contain any information that is illegally obtained or not obtained without prior consent
      
             6.Contain any material which does or could potentially infringe the intellectual property rights of a third party.
             
             7.Contain any information that is inaccurate
  • We will determine in our discretion whether there has been a breach of this clause 6. Where we believe a breach of clause 6 has occurred we may take such action as we deem appropriate. You agree that by breaching clause 6 you have caused, irreparable harm to us and others. This action may include the following:
              1.Immediate, temporary or permanent withdrawal of your right to use our site;

              2.Immediate, temporary or permanent removal of any posting or material uploaded by you to our site;

              3.Further legal action or any and all kinds against you;

              4.To initiate legal action for breach of reputation and;

              5.Disclosure of such information to law enforcement or authorities as we reasonably feel necessary.
  • In addition to all of our rights set out above, we reserve the right to take down any content that you upload to our site at any time without notice and without having to give a reason.
  • If Exclusivefarmland notice the use of its application inconsistent with the mentioned terms & conditions it may, terminate/temporarily block or make other temporary interruptions as a circumstance of the misuse by the user that may be deemed to be fit & proper. Each listing or contents uploaded on app or website goes through 2 step approval-
               1.Checked & approved by our partners.
               2.Verified by our admin.
        Any content found inappropriate during the approval process will not be uploaded on the app or website.

       Registration
  •  To gain access to certain details and services on our site you will need to register (free of charge) as a user in different capacity. You must be at least 18 years of age to register. At our discretion, we may refuse your application for registration. If we accept your application for registration, you will be given access at the point of application.        
  • Every registration is limited to a single user. You must not share your username and password with any other person or with multiple users on a network.
  • You undertake that all information provided by you for the purposes of registering with us is accurate and complete.   
  • You accept sole responsibility for all use of and for keeping secret any password that may have been given to you or chosen by you for use on this site. You will notify us immediately of any unauthorised use of them or any other breach of security of this site of which you become aware.
  • We have the right to disable any account or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms.

  • We reserve the right to bar users from this site and/or restrict or disable their access or use of any or all elements of our services, on a temporary basis at our sole discretion.
Suspension or withdrawal of website

  • We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons.   • We will not be liable for any failures due to software or internet errors or unavailability, or any other circumstances beyond our reasonable control.
  • We do not accept any liability for loss of your password or account ID caused by a breakdown, error, loss of power or otherwise caused by or to your computer system.
  • We may put in place such systems as we from time to time see fit to prevent automated programs being used to obtain unauthorised access to our system and this site. Subject to clause 13.1, we shall not be liable to you for any consequences arising out of or in connection with any such use or attempted use of automated programs to obtain unauthorised access to our system or this site.
  • We will not be liable for any loss or damage caused by a virus, distributed denial of service attack or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or any website linked to it.
  • If you choose to contact our members using the site, your details (including your e-mail address, telephone number and the address of the property you are considering a valuation on) will be sent to the member that you are enquiring with. We do not accept any liability for any subsequent communications that you receive directly from that member.
  • If you are a user then
            1.We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on 

             2.We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

                     1.Use of, or inability to use, our site; or

Payment Terms

  • The initial Payments to avail the Services offered by us as a subscriber shall be on a 100% advance basis. For any service provided by us, a Service Fee will be charged subject to the terms and conditions. The payment for Service once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated. Refund if any will be at the sole discretion of Limited. We offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Users card/bank accounts. User acknowledges and agrees that www.Exclusivefarmland.in, at its sole discretion and without prejudice to other rights and remedies that it may have under the applicable laws, shall be entitled to set off the amount paid or payable by a subscriber/user against any amount(s) payable by User to us under any other agreement or commercial relationship towards other products/services. Exclusivefarmland gives no guarantees of server uptime or applications working properly. All is on a best effort basis and liability is limited to refund of amount only. We undertakes no liability for free Services.
  • Exclusivefarmland uses the maximum care as is possible to ensure that all or any data / information in respect of electronic transfer of money does not fall in the wrong hands. For completing online transactions involving payments a user is directed to a Payment Gateway, we do store or keep credit/debit card data. Since the transaction happens on a third-party network not controlled by us, once a credit/debit card transaction has been completed, the payment information is not accessible to anyone at Exclusivefarmland after completion of the on-line transaction at the Payment Gateway, this ensures the maximum security.
  • Exclusivefarmland shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the user's account and / or information relating to or regarding online transactions using credit cards / debit cards and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise.
  • Our reconciliation team works on a 24 x 7 basis, we offer no guarantees whatsoever for the accuracy or timelines of the refunds reaching the Subscribers card/bank accounts. This is on account of the multiplicity of organizations involved in processing of online transactions, the problems with Internet infrastructure currently available and working days/holidays of financial institutions. Refunds in the event of wrong/objectionable property content being posted on the site would be at our discretions.
Termination
  • We may, without notice in its sole discretion, and at any time, terminate or restrict your use or access to www.Exclusivefarmland.in (or any part thereof) for any reason, including, without limitation, that we may on its judgement and perception believes you have violated or acted inconsistently with the letter or spirit of these terms and conditions or any applicable law
Governing Law
  • By accessing the Site you agree that the laws prevailing in India shall be the governing laws in all matters relating to site as well as these terms and conditions.
Dispute
  • Any disputes arising from or in relation to the use of this website shall be subject to the exclusive and sole jurisdiction of the competent courts situated in Madurai, India Alone.

Severability
  • THIS AGREEMENT between Exclusivefarmland and you governs your use of site. If any provision of these terms and conditions or part thereof are inconsistent with or are held to be invalid/void by or under any law, rule, order or regulation of any Government or by the final adjudication of any court, such inconsistency or invalidity shall not affect the enforceability of any other provision of the terms and conditions.
Waiver
  • he failure of Exclusivefarmland to exercise or enforce any right or provision of the terms and conditions of use shall not constitute a waiver of is right to enforce such right or provision subsequently.
